1. This Review Application is filed against the order dated 14.09.2023 wherein it was held that SA was disposed of as it was observed that there is need to adjudicate the SA, as the SA applicant has deposited the entire amount. The bank was directed to issue NOC and release the property papers within one week time and with the subject mortgaged property.

2. I have gone through the review application and it is admitted the fact that the respondent bank has failed in its duties to place on record what they are now trying to place.

3. The said order was passed in the presence of the counsel for the respondent bank and the entire charges which now they are claiming are already reflected in that order. Further, it is clearly observed that bank cannot take benefit of its own mistake in adjusting the amount of the borrowers in the loan account.

4. There is nothing in the review application which shows any error apparent on the face of record and deserves interference, therefore, the same stands dismissed.

5. The bank is directed to comply with the directions passed in the earlier orders within one week from today, failing which appropriate charges of Rs. 5,000/- per day, as per guidelines of Reserve Bank of India, shall be payable.

6. File be consigned to record, as per rules. Copy of order be uploaded on website.
