Indian Bank Respondent “A mention was made today by Ld.Counsel for the appellant before the DRAT Delhi having the additional charge.The Hon’ble Court has allowed the mention for placing the case on 27.10.2026.” Ld.Counsel for the appellant Shri D N Awasthi is present.
Ld. Counsel confirms that the array of the party is same as the Securitization Application filed before the Tribunal below and Respondent No. 2 has been arrayed as party as auction purchaser. Ld.Counsel mentioned pincode and details of court fee. Ld. Counsel filed Exemption Application (I.A.No.1630/2026)seeking exemption from filing certified copy of order of DRT. Ld. Counsel deleted multiple relief in relief sought. Regarding pre-deposit Ld. Counsel filed Waiver Application and vide said application he submits that against the demanded amount of Rs.11,93,884/- the appellant has already deposited Rs. 10 Lacs before this tribunal in Dy.No. 2065/2026,which was disposed of on 27.07.2026 and the appellant has not yet prayed for release of amount.Ld. Counsel further deposits Rs 2 Lacs towards pre-deposit vide D.D. No. 016554 drawn on Bank Of Baroda,dated 23.10.2026 in the name of Registrar, DRAT Allahabad. The total deposited amount is more than 50% of the debt due. Defects reconciled. The present Misc. Appeal is filed u/s 18 of the SARFAESI Act, 2002 on 26.10.2026 by Shri D N Awasthi , Ld. Counsel for the appellant against the Interim Order dated 22.10.2026 passed in the S.A.No.535 of 2023 by Debts Recovery Tribunal,Allahabad.
