1. Sh. Ashok Pandey, Counsel for the appellant stated that the fresh notice was issued to the respondents no.1, 3 and 4 in terms of order dated 11.08.2026 and he has already filed affidavit of service. None for respondents no.1, 3 and 4.
2. The reply / objection on behalf of respondent no.2 auction purchaser to the urgent hearing application bearing I.A. No. 1351/2026 has been filed. Let the copy be supplied to the Counsel for the appellant. However, I.A. bearing No. 1351/2026 does not require further adjudication as the appeal has already been taken up for hearing. Accordingly, I.A. bearing No. 1351/2026 stands disposed of.
3. Sh. Mohit Chawla, Counsel for the respondent no.2 stated that he wants to file reply / response to the appeal. Let the needful be done within two weeks with advance copy to the Counsel for the appellant. Sh. Chawla, Counsel in continuation of his submission made on 24.09.2026 stated that the respondent no.2 is not contemplated any further construction on the subject property and shall not be creating third party right in the subject property.
