This application is filed for condoning the delay of 45 days in filing the appeal. It is the submission of the learned counsel for the petitioner that SA 432/2025 has been filed by the respondent challenging the order passed under Section 14 of the SARFAESI Act and the same was allowed on 27.02.2026 on the ground that procedures had not been followed and also on the ground of limitation, which is not correct since the order under Section 14 of the SARFAESI Act has been passed by following the necessary and mandatory procedures. It is further submitted that copy application was made ready on 12.03.2026 and received by the Bank on 16.03.2026. Petitioner approached the panel advocate in Chennai to handover the original order copy and other records could not be received from the local counsel. It was received on 29.04.2026 and therefore, there is a delay. Petitioner has a good case on merits in the appeal and thus seeks for condoning the delay. Opposing this submission, learned counsel for the respondent submitted that the reasons stated for the delay cannot be accepted and prayed for dismissal of this application. Considered the rival submissions. In the circumstances stated in the affidavit filed in support of the application filed for condonation of delay and finding bonafides in the reasons stated for the delay, this Tribunal is of the view that the delay of 45 days in filing the appeal can be condoned subject to payment of costs of Rs.1000/- to the Library fund of DRT and DRAT Bar Association on or before 05.11.2026. Post the matter on 09.11.2026 for reporting compliance. Sd/-
