IN THE DEBT RECOVERY APPELLATE TRIBUNAL AT CHENNAI

M.A:4/2025

R Duraisamy V/S Indian Overseas Bank 22/10/2026

Learned Counsel for the Appellant is present. No representation for the Respondent Bank.

This appeal is filed against the order dated 31.3.2023 by the Learned Presiding Officer, DRT, Coimbatore, in Appeal No. 4 of 2017.

The appeal under Section 20(1) of the RDB Act, 1993 has been filed in Appeal No. 4 of 2017 for the following reliefs:

To cancel the 3rd Respondent e-auction proceedings dated 15.11.2017 as per the e-auction sale proclamation notice dated 3.10.2017 as null and void;

To set aside / modify the final orders passed in O.A. No. 55 of 2014;

To order the Respondents to maintain status quo of the recovery proceedings till the disposal of this appeal;

To order the Respondents not to disturb the peaceful possession and enjoyment of the Appellants property;

To order the Respondents to produce complete records of the recovery proceedings;

To permit the Appellant to redeem their mortgage property; and

Any other order or orders which the Hon’ble Tribunal may deem fit in the interest of justice.

The Learned Presiding Officer, DRT, Coimbatore found that the appeal has not been filed in accordance with the provisions of Section 30 of the RDB Act, 1993 and that the appeal has not challenged any order passed by the Learned Recovery Officer and, therefore, the appeal cannot be entertained. Against this finding and the order, this appeal is filed.

Learned representing Counsel for the Learned Counsel on Record for the Appellant seeks adjournment.

Therefore, post the matter on 2.11.2026 for arguments, as a last chance. Failing to argue the matter would result in passing appropriate orders.
