IN THE DEBT RECOVERY APPELLATE TRIBUNAL AT CHENNAI

IA 704/2026 (Delay) In A.IR:2813/2025

Sini Devaraj V/S State Bank of India

23/10/2026

Learned Counsel for both sides are present.

This application is filed for condoning the delay of 17 days in filing the appeal.

It is the submission of the Learned Counsel for Petitioner/Appellant that after the disposal of SA No. 493 of 2022 on 31.10.2025, Petitioner initiated talks with the Respondent Bank for an amicable settlement. The settlement talks have not materialised positively. This was the reason for the delay of 17 days in filing the appeal, and thus, seeks to condone the delay.

Learned Counsel for Respondent Bank opposes this application on the ground that the reasons stated for the condonation of delay are not acceptable and sufficient.

Considering the reasons stated by the Learned Counsel appearing for the parties, and that the delay is only 17 days in filing this appeal, this Tribunal, with a view to give an opportunity to the Petitioner to prosecute this appeal on merits, is of the view that the delay condonation application can be allowed, subject to payment of costs of Rs.1,000/- to the Library of DRT / DRAT Bar Association, Chennai, on or before 6.11.2026.

Call on 10.11.2026.
