1. Present as under: Mr. Danish Chamadia along with Mr. Aman Sadiwala i/b M/s. RRSG Formal Legal LLP, Counsel for Appellant. Mr. Charles De’souza along with Mr. Nikhil Salvi & Mr. Viral Joshi, Counsel for Respondent.
2. The Learned Counsel for the Appellant would submit that I.A. No. 580/2026 is filed for withdrawal of present Misc. Appeal. She would further submit that the OTS proposal has been accepted by the bank ; that , there is a pre-deposit amount which is lying in the registry DRAT-Mumbai and she seeks directions to transfer the pre-deposit amount of waiver directly to the Respondent/ARC towards settlement of dues.
3. Respondent has no objection to the same.
4. Accordingly, I.A. No. 580/2026 is allowed.
5. The registry is directed to transfer the pre-deposit amount which is deposited by the Appellants directly to the Respondent/ARC.
6. All pending I.As., if any, stand dismissed. Sd/- Chairperson 07.10.2026
