The Learned Counsel for the Applicant would submit that the Securitisation Application No. 16/2022 is dismissed for default vide order dated 12.10.2023 passed by the Learned DRT-III, Mumbai, therefore, the present Misc. Appeal has become infructuous and seeks permission to withdraw the same. He tenders the pursis to the same effect with the copy of the order dated 12.10.2023. Same is taken on record.
