AAG Order of The Tribunal M.A. No. 1970/2025 This M.A. has been filed by the applicants praying to allow them to continue against the post of Lab Technician and their service status may kindly be protected keeping in view the fact that 3 posts of the Lab Technician are already lying vacant. They placed reliance on the case of similarly situated persons, who had approached before the Hon'ble Supreme Court in LPA(C) No. 12238/2023 titled Minakshi Kumar & Ors versus Union Territory of J&K & Ors, wherein the Hon'ble Apex Court had already given interim protection vide Order dated 23.06.2023. In the light of decision rendered by the Hon'ble Supreme Court in the said case, respondents are directed that status-quo shall be maintained with regard to the termination of services of the petitioners and they are allowed to continue in case the posts are lying vacant with the Department.

Accordingly, MA stands allowed. CP No. 354/2025 List on 25.02.2026.
