CENTRAL ADMINISTRATIVE TRIBUNAL SRINAGAR Order Sheet Item no.: 23 O.A./714/2026 (SRINAGAR) [ PENSIONARY BENEFITS ] [ SENIOR CITIZEN ] Court No.: 2 No of Adjournment: 3 Order Dated: 22/10/2026 MOHD SULTAN SHAH Vs FOOD CIVIL SUPPLIES AND CONSUMER AFFAIRS

For Applicant(s) Advocate : MS. HOWRAH SHOWKAT VICE MS. SEHREEN ZEHRA

For Respondent(s) Advocate : FURQAN SOFI - GA, MS. RAAHILA Order of The Tribunal 01/ The case pertains to release of pension and its allied benefits to the petitioner and various detailed orders were passed by the court from time to time in this matter. 02/ On 07-10-2026, respondents were directed to comply with the earlier direction of the court dated 11-07- 2027 in its letter and spirit. Ms. Raahila, learned counsel appearing for the respondent - office of the Accountant General, Srinagar, submitted that reply stands filed on her behalf. However, rest of the respondents are yet to come up with their stand. 03/ This court is at pains to notice that the pensioners are made to suffer, which, otherwise could be very well taken care of by the respective HODs by devising a pension friendly mechanism. Needless to say that, of course, at times, settling of pension gets delayed for the reasons that either enquiries are pending or there are certain outstandings, but those have to be dealt with in accordance with law and for this reason, the competent authority is not powerless to release the provisional pension in favour of a pensioner. 04/ In the aforesaid backdrop, Mr. Furqan - GA, is directed to comply with the earlier directions of the court in their letter and spirit. It needs a mention here that despite opportunities, the reply, having not been filed by some of the respondents, the court would have very well sought personal presence of the Joint Director, Food & Civil Supplies and Consumer Affairs Department, Kashmir, for gross non compliance and disobedience of its orders, but because of the submission made by Mr. Fuqan - GA, appearing for respondents 1,3,4 & 5, that he will comply with the orders within two weeks' positively, a lenient view is taken and it is made clear that failure to do the needful within the stipulated period, the court will be compelled, in the peculiar facts and circumstances of the case and in order to uphold the majesty of law, to seek personal appearance of the Director, Food & Civil Supplies and Consumer Affairs Department, Kashmir, before the court on next date of hearing, so that matter is decided with utmost promptitude, particulary, when same relates to release of the pension and other allied benefits to the petitioner, who has already superannuated about eight years back. 05/ List for consideration on 05-11-2026. Registry to convey this order to the Director, Food & Civil Supplies and Consumer Affairs Department, Kashmir.
