CENTRAL ADMINISTRATIVE TRIBUNAL SRINAGAR Order Sheet Item no.: 4 O.A./50/2023 (SRINAGAR) [ COMPASSIONATE APPOINTMENT ] Court No.: 2 No of Adjournment: 23 Order Dated: 16/10/2026 MUSHTAQ AHMAD SHAH Vs M/O DEFENCE

For Applicant(s) Advocate : B.A.MALLA

For Respondent(s) Advocate : M/S. A.S.SODHI & TUBA MANZOOR Order of The Tribunal 01/ A detailed order was passed on 11-09-2026, whereunder Mr. Sodhi, learned counsel appearing for the official respondents, was directed to produce the record pertaining to compassionate appointment of respondent No.5 – Mohammad Mashkoor Dar, before the court. 02/ Matter came up for consideration today and the record has been produced. Learned counsel for the petitioner submitted that despite the respondent No.5 being married, his case was considered for compassionate appointment but in the case of petitioner, same has been denied on the ground that he was married. 03/ Mr. Sodhi, to file an affidavit as to whether respondent No.5 was married at the time when he was accorded consideration for compassionate appointment. In the meanwhile, Mr. Tuba Manzoor, learned counsel appearing for respondent No.5, to file his reply too if required. 04/ Since the matter pertains to the issue of compassionate appointment, the affidavit, as sought for supra, should be filed in the light of law laid down by the apex court in case titled as Malaya Shetty Nanda versus State of Orissa, Civil Appeal NO. 4103/2022, wherein the apex court has categorically mandated that disposal of matters relating to compassionate appointments shall not be delayed as the delay defeats the very purpose of compassionate appointment. 05/ Mr. Sodhi to convey this order to the respondents for its compliance. 06/ List for consideration on 18-11-2026. Record is returned to Mr. Sodhi, in the open court. M. S. Latif Member (J) Tariq Mota ( ps consultant )
