This Chamber Appeal has been filed by the Applicant bank on 20.08.2026 against the order of Ld. Registrar dated 18.08.2026 passed in Original application diary no.1071 of 2025 whereby Ld. Registrar declined to register the Original application on the grounds that the affidavits regarding capitalization of penal interest and address are not filed, the original application is not filed with bank official designation stamp, welfare stamp not affix on vakalatnama and 3rd part of OA filed without index outstanding amount calculation sheet not filed.

It is submitted by the Ld. Counsel for Applicant Bank that the original application was duly refiled online on 31.01.2026 in e-DRT portal the e-DRT portal through which OA was filed itself reflects that the defects stood duly addressed. The Counsel for applicant dispatched the physical copy of the calculation sheet to the registry. Ld. Counsel for Applicants subsequently became aware that the document never reached the registry and was marked undelivered. As the counsel for the applicant never received back the said return it was bona fide assumed that the document duly served.

So, there was no deliberate omission or lapse on the part of the Ld. Counsel for Applicants. It is further submitted that declining registration of the OA would cause grave and irreparable injustice to the applicant bank and there was no deliberate delay in curing defect.

Heard Ld. Counsel for the Applicant Bank and perused the original application. The prayer of the Applicant Bank is allowable. Hence, allowed.
