This application is filed to restore Appeal AIR (SA) 1238 of 2023 to the file.
As per the orders of the Hon’ble High Court of Judicature at Madras in WP No. 48298 of 2025, it is informed by the Learned Counsel for Petitioner/Appellant that Petitioner made a deposit of Rs.3,23,85,772/- towards the short fall of 25% of pre-deposit ordered by the Hon’ble High Court of Judicature at Madras.
The Hon’ble High Court of Judicature at Madras directed this Tribunal that in the event of such a deposit being made, to entertain the appeal and decide it on merits and in accordance with law. By the said order, the order passed by this Tribunal on 30.1.2025 was set aside.
In view of the compliance of the order of the Hon’ble High Court of Judicature at Madras, Registry is directed to number the appeal, if it is otherwise in order, and list it for hearing on 11.12.2026, after completion of service pending, if any, and pleadings.
Learned Counsel for R1 Respondent Financial Institution is present.
In view of the order passed by the Hon’ble High Court of Judicature at Madras in WP No. 48298 of 2025, setting aside the order passed by this Tribunal on 30.1.2025, and directing this Tribunal to entertain the appeal on merits, Miscellaneous Application 98 of 2026, filed for restoring this appeal, is dismissed as not necessary.
