ASSET RECONSTRUCTION COMPANY (I) LTD. vs Image Plus(India) Private Limited & Ors on 23 October 2026

1. Present as under:

Mr. Shakib D along with Mr. Chinmay Bhojane, i/b M/s. Vidhii Partners, Counsel for the Appellant. Ms. Somya, i/b M/s. T.N. Tripathi & Co., Counsel for Respondent No. 1 & 4. No representation for the Respondent Nos. 2, 5 & 6 despite repeated calls.

2. The Learned Counsel for the Appellant would submit that Respondent Nos. 2, 5 and 6 had already been deleted at the time of removal of the objections. However, the names of Respondent Nos. 2, 5 and 6 have not been deleted from the Interim Application filed along with the main Appeal.

3. The Appellant is directed to file appropriate applications for deletion of the names of Respondent Nos. 2, 5 and 6 from the Miscellaneous Applications and Interim Applications, if any, wherein they continue to be arrayed as Respondents.

4. The Learned Counsel for the Appellant would submit that Respondent No. 3 has expired and I.A. (Diary) No. 790/2023 has been filed for bringing the legal heir of Respondent No. 3 on record. However, the said application is under objection raised by the Registry on the ground that the death certificate of Respondent No. 3 has not been filed.

5. The objection raised by the Registry is overruled.

6. Issue notice to the proposed legal heir of Respondent No.3 by registered speed post.

7. Steps be taken within two weeks.

8. List the case on 03.12.2026 before the Ld. Registrar for compliance and service. Sd/- Chairperson 23.10.2026 Psa-05
