CENTRAL ADMINISTRATIVE TRIBUNAL SRINAGAR Order Sheet Item no.: 30 M.A./1885/2025 (SRINAGAR) [ MA FOR AMENDMENT ] In O.A./1611/2021 REGULARIZE THE SERVICE M.A./1886/2025 RELEASE OF SALARY Court No.: 2 No of Adjournment: Order Dated: 31/12/2025 RAFIQA BANO Vs D/O HORTICULTURE, JAMMU AND KASHMIR
For Applicant(s) Advocate : MR. SHEIKH MUSTAQ
For Respondent(s) Advocate : MR. SYED MUSAIB, DAG Order of The Tribunal ***ORDER IN M.A./1886/2025*** Perusal of the order dated 27.03.2025 reveals that learned counsel for the respondents had submitted that the petitioner was receiving her salary regularly; however, learned counsel for the petitioner had submitted that the petitioner had not been paid her salary. In view of the rival submissions, the respondents were directed to clarify their position regarding the release of the petitioner’s salary on or before the next date of hearing. Again, when the matter came up for consideration on 23.05.2025, learned counsel for the petitioner submitted that, in view of the developments that had taken place during the pendency of the main petition, and in terms of the law laid down by the Hon’ble Supreme Court as well as by the Division Bench of the Hon’ble High Court of Jammu and Kashmir, he intended to file an application seeking amendment of the petition. The prayer was allowed. Learned counsel for the respondents, Mr. Syed Musaib, DAG, submitted that the unpaid dues of the petitioner had already been released. Thereafter, on 08.08.2025, learned counsel for the petitioner sought time to file the amended petition, which was granted to enable him to do the needful. Today, the matter again came up for consideration. Learned counsel for the petitioner has filed the instant M.A./1886/2025, seeking release of her legitimate salary, which, according to the petitioner, has been illegally and arbitrarily stopped by the respondents. Issue notice in M.A./1886/2025. Mr. Syed Musaib, learned DAG, accepts notice on behalf of the respondents and is granted four weeks’ time to file objections to the said M.A. In the meanwhile, subject to objections from the other side, it is ordered that the legitimately earned salary of the petitioner be released in her favour, if she has been working and is continuing in service, and there is no other legal impediment in such release. It is made clear that this direction shall remain subject to the final outcome of the O.A. List this matter on 19.02.2026. M. S. Latif Member (J) Shubham Sharma ( steno 'd' )
