Counsel for the parties present. The applicant being aggrieved with non-inclusion of his name in the provisional panel for promotion to the post of Chief Loco Inspector, Level-7 seeking relief as prayed for in para 8 of the OA. Considering the material available on record at the relevant time as well as the fact that the representation of the applicant dated 14.05.2026 for redressal of his grievance is pending before Competent Authority of the respondents, this Tribunal issued noted to the respondents and kept it returnable on 20.05.2026 and directed the respondents to file the reply as well as to place a copy of decision, if any taken on the pending representation of the applicant. During the pendency of the OA, the respondents have decided the representation of the applicant by passing a speaking order dated 09.07.2026 wherein it was mentioned that the applicant is not eligible for promotion to the post of CLI, Level-7 and hence his name is deleted from the eligibility list. Being aggrieved with the said speaking order dated 09.07.2026, the applicant intends to challenge the same for which he has filed the M.A. No. 450/2026 for amendment in the OA. On the other hand, counsel for the official respondents objected to the said amendment on the ground that in the reply to the OA they have contended that the applicant is found to be not eligible in accordance with the extant rules and accordingly his name has not been placed in the provisional panel list. Further, it is submitted that from day one, the applicant is not eligible to participate in the selection process. Further, it is submitted that the said MA for amendment will change the nature of the OA and even the respondents have annexed the said speaking order dated 09.07.2026 to their reply. Heard learned counsel for the parties on M.A. No. 450/2026. Considering the aforesaid submissions, we are satisfied with the grounds stated in the MA; the M.A. No. 450/2026 is allowed. Accordingly, learned counsel for the applicant is directed to carry out necessary amendment in the OA and supply its copy to the counsel for the respondents. On receipt of copy of amended OA, the respondents may file additional reply to it, if so desire within a week thereon. List the OA on 29.10.2026.
