CENTRAL ADMINISTRATIVE TRIBUNAL AHMEDABAD Order Sheet Item no.: 6 O.A./511/2026 (AHMEDABAD) [ SENIORITY ] Court No.: 1 No of Adjournment: Order Dated: 08/10/2026 SHAILESH SON OF JOSEPH VAGHELA Vs DEBT RECOVERY TRIBUNAL

For Applicant(s) Advocate : HARSHAL N PANDYA

For Respondent(s) Advocate : Order of The Tribunal

In the instant OA, the applicant being aggrieved by the notice dated 16.09.2026 issued by the respondents, whereby the applicant has been directed to submit his objections, if any, in respect of the revised draft seniority list in the cadre of Private Secretary, has filed the present OA. Ms.Harshal N. Pandya, learned counsel appearing for the applicant, submitted that the settled seniority of the applicant is sought to be unsettled by the respondents by way of the impugned notice. Against the said notice, the applicant has submitted a detailed representation dated 22.09.2026, which has not been considered or decided till date. It is further submitted that the applicant has reason to believe that his settled seniority in the Grade of Private Secretary is sought to be revised only to accommodate Respondent No.4 herein. It is stated that, although the applicant was eligible to be considered for promotion to the post of Registrar on the basis of his seniority, the same was denied to him, pursuant to which the applicant has filed OA No.382/2026, which is pending adjudication before this Tribunal. In the meantime, it is submitted that, in order to protect the alleged irregularity in maintaining the seniority, the respondents have decided to revise the settled seniority of the applicant after a lapse of nearly 19 years. It is further submitted that, despite the detailed representation submitted by the applicant, the same has not been considered till date. The applicant has a serious apprehension that his accrued rights would be jeoparadised, if the proposed revision of seniority is not protected by an appropriate interim order of this Tribunal. Heard learned counsel for the applicant and perused the material available on record. Issue notice to the respondents in the OA as well as on the Interim Relief returnable by 02.11.2026. The respondents are directed to consider and decide the pending representation of the applicant and, if the same has already been decided, place a copy of the order before this Tribunal by the next date of hearing for its perusal. Till then, the proposed revision of the seniority of the applicant shall remain stayed. List the matter on 02.11.2026. Direct Service is permitted to R-3. Applicant is permitted to serve R-2 by Speed Post. Sanjiv Kumar Member (A) Jayesh V Bhairavia Member (J) Seema Kv ( ps )
