PRAYER: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus directing the respondent, namely the District Registrar (Societies Registration)Sivagangai District to consider and register of the Form VII
submitted by the petitioner society on 07.09.2026 pursuant to the Annual General Body Meeting held on 06.09.2026, recording the continuation of the Executive Committee and office bearers for the triennium 2026-27.
2027-28 and 2028-29 and to take the same on file and record the change in the statutory register within a time frame to be fixed by this Court.

ORDER
Seeking to direct the respondent to consider and register of the Form VII submitted by the petitioner society on 07.09.2026 pursuant to the Annual General Body Meeting held on 06.09.2026, recording the continuation of the Executive Committee and office bearers for the triennium 2026-27. 2027-28 and 2028-29 and to take the same on file and record the change in the statutory register, this writ petition is filed.
2. The petitioner is a society represented by its Secretary / Correspondent, which is running Dr.Zakir Husain College, Ilayangudi, a minority aided college. The petitioner society is governed by the Memorandum and By-laws and by the provisions of the Tamil Nadu Societies Registration Act 1975. The annual general body meeting for the petitioner society for the current year was duly convened and held on 06.09.2026 at 10:30 a.m. at the premises of Dr.Zakir Husain College, under the chairmanship of Janab S.M.Ahamed Jalaludeen. Due notice of meeting was issued to the members. The notice dated 10.08.2026, the
WP(MD) No. 28403 of 2026 publication / service records and the proceedings of the meeting are available with the petitioner society.
3. The society comprises a total number of 1,111 members. Out of the total membership, 447 members were present at the annual general body meeting held on 06.09.2026. The meeting was therefore attended by a substantial number of members as required under law, and the proceedings were conducted in accordance with the governing By-laws and applicable statutory provisions.
4. One of the principal matters placed before the general body was the constitution / election of Executive Committee for the triennium comprising the years 2026-27, 2027-28 and 2028-29. The matter was discussed in detail before the general body. After due deliberation, 416 members of the general body unanimously resolved that the existing Executive Committee / office bearers should continue for the ensuing triennium 2026-27, 2027-28 and 2028-29. The continuation of the existing Executive Committee was the result of a resolution of the general body and was not the unilateral act of the office bearers.

Pursuant to which, on 07.09.2026, the petitioner society submitted Form VII before the respondent under Rule 17 (2) of the Tamil Nadu Societies Registration Rules 1978, intimating the continuation of the members of the Committee and the office bearers for the triennium 2026-27, 2027-28 and 2028-29 along with supporting documents. However, the same is kept pending, citing the pendency of W.P(MD)Nos.25624 and 28403 of 2026 and also the suit in O.S.Nos.44 & 45 of 2026 on the file of District Munsif Court, Ilayangudi. The learned counsel pointed out that no interim order is pending as against the petitioner before any of the pending cases. Earlier, this Court has dealt with a matter pertaining to the same society in W.P(MD)No.3108 of 2024 when the District Registrar had received a Form VII submitted by the petitioner society in the same manner citing pendency of writ petition, which was frowned upon by this Court, directing the District Registrar to accept the Form VII submitted by the petitioner society in the absence of any interim order as against the society and on similar basis sought the indulgence of this Court.
6. The learned Additional Government Pleader submitted that they would comply the order of this Court.

7. Heard the learned counsels on either side and carefully perused the materials available on record.

In tune with the order passed by me in W.P(MD)No.3108 of 2024, dated 16.02.2024, I find it necessary to direct the respondent to accept the Form VII submitted by the petitioner in the absence of any interim order passed by this Court in W.P(MD)Nos.25624 and 28403 of 2026 and the civil suit in O.S.Nos.44, 45 & 49 of 2026 on the file of District Munsif Court, Ilayangudi, forthwith.
