PRAYER: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of MANDAMUS or any other appropriate order or direction or order in the nature of writ directing the Respondents to release the pledged jewels vide Jewel Loan Card No. 62
under the Crop Loan Waiver Scheme announced by the Government of Tamil Nadu, by duly considering the Petitioner’s representation dated 28- 09-2026 within the period that may be stipulated by this Honble Court and pass such further or other orders as this Honble court may deem fit and proper in the circumstances of this case and thus render justice.

ORDER
This writ petition has been filed seeking for a direction the respondents to release the petitioner’s pledged jewels vide Jewel Loan Card No. 62 under the Crop Loan Waiver Scheme announced by the Government of Tamil Nadu, by duly considering the Petitioner’s representation dated 28.09.2026.

The learned counsel appearing for the petitioner submitted that the petitioner had pledged her jewellery weighing 88.00 grams with the Periya Perali Primary Agricultural Cooperative Credit Society situated in his area, in the year 2014 and the same had become defunct. However, in the meanwhile, the Government of Tamil Nadu in the year 2021 had announced waiver in respect of farmers’ crop loan, pursuant to which the petitioner’s loan was waived and a waiver certificate bearing No.09996 was also issued to the petitioner. Even thereafter, the pledged jewellery is not returned by the said credit society. Hence, the petitioner had made a representation on 28.09.2026. The same was not considered. Hence, this petition came to be filed.
3. The learned counsel appearing for the respondents 1 to 3 submitted that, since the Society has become defunct, the jewellery appears to be in the safe custody of the second respondent Bank. It is further submitted that the Deputy Registrar of Cooperative Societies, Virudhunagar Circle, is the competent authority to take a decision in the matter.
4. Heard the learned counsel on either side and carefully perused the materials placed before this Court.

Considering the facts and circumstances of this case, the Administrator, Periya Perali Primary Agricultural Cooperative Credit Society, Virudhunagar District and the Deputy Registrar of Cooperative Societies, Virudhunagar Circle, Virudhunagar District are suo motu impleaded as the respondents 3 and 4 respectively. Registry is directed to carry out necessary amendment in this regard.
6. The fourth respondent is directed to take a final decision on the issue within a period of two weeks from today. With this direction, this writ petition stands disposed of. No costs.
