ORDER

The petitioner had earlier approached this Court by filing W.P.(MD) No.20265 of 2026 challenging order dated 01.07.2026 of the fourth respondent herein. Upon being informed that said order was withdrawn, the Writ Petition was disposed of on 31.07.2026. The petitioner also filed W.P.Crl.(MD) No.5398 of 2026 seeking police protection so as to enable the petitioner to carry on his business without unlawful interference. Said petition was disposed of on 28.09.2026 by directing the respondents therein to consider the petitioner's representation and pass appropriate orders within a period of 6 weeks. Apprehending that the respondents would interfere with the business, including the construction activity proposed at the site, the petitioner has again approached this Court.

2. Mr.P.Pethu Rajesh, learned Additional Government Pleader, accepts notice for the first to third and fifth respondents. Mr.C.Deepak, learned Additional Government Pleader, accepts notice for the fourth respondent.

WP(MD) No. 30495 of 2026

3. Learned Additional Government Pleader for the first to third and fifth respondents submits that the petitioner has suppressed facts relating to earlier proceedings before this Court. He also submits that the respondents were directed to pass appropriate orders on the representation seeking police protection within 6 weeks and that the petitioner has approached this Court prematurely. In addition, he submits that the respondents merely visited the site to ascertain whether any unlawful activity was being carried out, but did not obstruct activity. This statement is recorded.

4. Considering the above submissions and the documents on record, this Writ Petition is disposed of by directing the respondents not to interfere with any lawful construction activity by the petitioner. This order will not, however, stand in the way of any action being taken in accordance with the law by following due process. For the avoidance of doubt, it is clarified that the petitioner shall not operate the poultry farm without obtaining consent to operate from the Tamil Nadu Pollution Control Board. There shall be no order as to costs. 27-10-2026 Index: No Speaking Neutral Citation: No JEN
