On the recommendations of the Departmental Promotion Committee (DPC), the petitioner was promoted as Senior Assistant on 27.07.2007. He was further promoted as Superintendent Grade-II on 26.07.2014. Superintendent Grade-II as it stood on 31.12.2022 (Annexure P-1), circulated vide office letter dated 25.08.2023, apart from reflecting petitioner’s position at serial No. 2 in the list, also depicts his date of promotion as Superintendent Grade-II as 25.07.2014. It appears that the petitioner preferred a representation on 02.02.2026 (Annexure P-3) against an office letter dated 25.04.2025, a copy of which is not on record. As per petitioner’s representation (Annexure P-3), the respondent Department issued the final seniority list of Superintendent Grade-II as it stood on 31.03.2014, wherein the names of petitioner’s juniors have been placed above him. The petitioner seeks a decision on his representation. As noted earlier, no such final seniority list circulated vide office letter dated 25.04.2025 has been placed on record. The only seniority list placed on record is appended as Annexure P-1, circulated vide office letter dated 25.08.2023, depicting the positions of Superintendent Grade- II as on 31.12.2022, wherein name of petitioner figures at Serial No.2.

4. In the given facts and circumstances, the relief claimed for by the petitioner cannot be granted to him in view of the specific pleadings and the documents appended to the writ petition. Accordingly, the writ petition is disposed of with liberty reserved to the petitioner to file fresh petition in accordance with law with proper pleadings & supporting documents.

Pending miscellaneous applications, if any, shall also stand disposed of.
