Criminal Original Petition filed under Section 528 of The Bharatiya Nagarik Suraksha Sanhita, 2023, praying to permit the petitioner to travel abroad to Europe i.e to depart from India on or after 13.11.2026 and to return to India on or before 01.12.2026 and to also direct the suspension of any LOC as against the petitioner in order to facilitate his travel.

The petitioner is the 16th accused in C.C.No.554 of 2023 on the file of the learned Additional Chief Metropolitan Magistrate at Egmore,

Chennai. The petitioner seeks permission to travel to France and Switzerland in order to attend the graduation ceremony of his elder daughter at INSEAD Europe Campus, France.
2. Normally, the petitioner would have to file an application seeking permission of the Trial Court. He is unable to do so on account of the fact that the entire proceedings before the Trial Court has been kept in abeyance pursuant to the orders passed by the Supreme Court in S.L.P. (Crl.) Nos.2429 to 2341 of 2024 dated 29.04.2026. In order to ascertain the views of the prosecuting agency, I requested Mr.K.Srinivasan, learned Senior Counsel and Special Public Prosecutor for CBI Cases, to go on record by way of a counter. Counter has been filed.
3. The main objection seems to be that the petitioner has not stated the country where he is going to travel. France and Switzerland are the countries he seeks permission to travel and they are specifically mentioned in paragraph No.9 of the petition. As the proceedings have been kept in abeyance by the Supreme Court and since the petitioner has filed an undertaking affidavit to return to this country on or before 01.12.2026, this Court is inclined to grant him the permission to travel. The details of his accommodation in Europe have been enclosed in the typed set of papers, which has been served on the learned Special Public Prosecutor.

4. The petitioner is permitted to travel abroad on the following conditions: ‘a. The petitioner shall ensure that his counsel will duly represent him during his absence for which he undertakes to execute special vakalat;
b. The petitioner shall attend to the inquiry by the respondent as and when he had been called and will travel back to India, in case his presence, if absolutely required;
c. The petitioner shall attend to the inquiry by the respondent police as and when his presence is required, after his return from Europe on or before 01.12.2026;
d. The petitioner shall not flee away from the course of the investigation or from the process of law;
e. The petitioner shall furnish the address of the places where he has made arrangements to stay, to the respondent, through email, upon booking the same;

g. The petitioner shall deposit the original FD Receipt bearing No.10253447047 dated 04.11.2025 for Rs.25,00,000/- (Rupees Twenty Five Lakhs) in Fixed

Deposit Senior Citizen Payout maintained with IDFC First Bank, Borivali Branch, with the Registrar General of this Court;
h. The petitioner shall file his compliance affidavit with necessary proof of return on his return from Europe. Thereafter, this Court will pass orders on return of the original Fixed Deposit Receipt submitted;
i. The petitioner shall not pursue citizenship or residence at any other country.
4. Since this Court has granted permission for the petitioner to travel abroad, the investigating agency shall forthwith inform the Department of Immigration to suspend the LOC issued against the petitioner from the midnight of 12.11.2026 to the midnight of 02.12.2026.
