ORDER

The present petition has been filed by Accused No. 5 seeking a direction to accept his surrender petition and to recall the Non-Bailable Warrant dated 30.07.2026 issued in S.C. No. 59 of 2023, pending on the file of the Subordinate Court, Srivaikuntam.

2. According to the learned Counsel appearing for the respondent police, even though the final report was filed and taken on file in the year 2023, so far the case has been adjourned only for the appearance of the accused persons. Of the five accused persons, each has been taking turns in remaining absent on different hearing dates, thereby there is no progress in the trial.

3. Considering the above facts and circumstances, this court is inclined to pass the following orders:

a) The petitioner is directed to surrender before the learned Subordinate Court on or before 29.10.2026.

b) On such surrender, the Non Bailable Warrant (NBW) shall be recalled on the same day.

CRL OP(MD) No. 24027 of 2026

c) The trial Court is directed not to dispense with the presence of the petitioner for the future hearings.

4. With the said observations, this Criminal Original Petition is disposed of. 26-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No gvn Note: Issue order copy on 26.10.2026
