ORDER

This civil revision petition has been filed under Article 227 of the Constitution of India against the order dated 04.08.2026 passed in I.A.No.2 of 2026 in A.S.No.1 of 2026 on the file of Subordinate Court, Nagapattinam, wherein the application filed by the petitioner/appellant seeking for stay of the operation of the counter claim ordered in favour of the respondent, came to be dismissed by the Court below.

2. Heard learned counsel on either side and carefully perused the materials available on record. This Court also went through the impugned order.

3. When the civil revision petition came up for admission on 07.09.2026, this Court ordered notice to respondent and in the mean time, directed status quo to be maintained. When the matter was taken up for hearing today, it is brought to the notice of this Court that the Subordinate Court, Nagapattinam, has taken up the appeal for final hearing and it is posted on 30.10.2026 for the arguments on the side of the respondent.

4. Learned counsel for petitioner submitted that the trustee has locked the temple.

5. On the other hand, learned counsel for respondent submitted that the archakar is residing inside the premises and he has locked from inside as a result of which, the general public are not in a position to worship in the temple. Therefore, learned counsel appearing on either side requests this Court to clarify the order of status quo passed on 07.09.2026, till the disposal of the appeal.

6. In the considered view of this Court, the appeal has already reached the stage of final hearing. Therefore, some time frame can be fixed by this Court for the disposal of the appeal. In the mean time, the temple can be thrown open and the petitioner can be allowed to perform pooja and the general public can also be allowed to worship in the temple. This interim arrangement can continue till the disposal of the appeal.

7. There shall be a direction to the Subordinate Court, Nagapattinam, to dispose of A.S.Nos.1 and 14 of 2026 within a period of eight (8) weeks from the date of receipt of a copy of this order. This civil revision petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed. 26-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No gm
