9. In this regard, the petitioner sent a representation to the Department namely, the Head Passport officer, No.1, Banumathy Ramakrishna Road, Barani Colony, Vijayaraghavapuram, Saligramam, Chennai 600 093, on 05.12.2019. However, the said representation has not been considered by the respondents.
3. The learned Senior Panel Counsel appearing for the respondents 1 to 6 submitted that an enquiry was conducted based on the petitioner’s complaint and the respondents 8 and 9 denied the allegations made against them however, they were advised to treat the applicants in a polite and respectful manner. The said communication was also addressed to the petitioner vide letters dated 10.09.2020 and 17.03.2022 in response to his applications under the Right to Information Act, 2005. A perusal of the counter affidavit indicates that an enquiry was conducted, however, no response was communicated to the petitioner in respect of his representation dated 05.12.2019.
5. Though the learned Senior Panel Counsel contended that the issue had already been resolved, this Court is unable to accept the said contention, as no reply was sent to the petitioner in response to his representation. Hence, this Court directs the seventh respondent to consider the petitioner’s representation dated 05.12.2019, according to its own merits and pass appropriate orders, in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order.
