Heard Ms.A.Preetha, for Mr.R.Krishnaswamy, learned counsel for the petitioner and Mr.C.Gauthamaraj, learned Standing Counsel for the first respondent and Mr.C.S.K.Sathish, learned counsel for the second respondent.

2. This writ petition has been filed seeking a Writ of Mandamus directing the Respondents to pay the petitioner a difference in dearness allowance payable to the petitioner for the period from 1.1.2017 to 30.12.2019, to pay arrears of difference in pension for the period from 01.04.2020 to February 2023 and to pay a difference in earned leave / medical leave and to pay the petitioner the surrendered earn leave wages for 30 days and to pay the petitioner the family benefit fund scheme, to pay the petitioner the IRT Contributions and to pay the petitioner the rate of 12% per annum for the belated payment of Rs.6,89,017 /-towards PF and for the belated payment of Rs.88,990 /- towards surrendered Earned leave salary for the belated payment of Rs.7,69,095 /- towards gratuity amount within a specified time frame, as may be fixed by this Court.

3. This matter earlier came up for consideration on two occasions, on 11.09.2026 and 25.09.2026 and the same were adjourned to enable the respondents to file counter-affidavit.

WP No. 37016 of 2026

4. Today when the matter is taken up for consideration, Mr.C.S.K.Sathish, learned counsel appearing for the second respondent submits that the second respondent has already paid amounts that are due and payable to the petitioner towards IRT, surrender leave and pension arrears to the tune of Rs.4,500/-, Rs.12,409/- and Rs.21,448/-, after filing of the present Writ Petition.

5. Mr.C.Gauthamaraj, learned Standing Counsel appearing for the first respondent submits that the amounts that are due and payable to the petitioner towards Dearness Allowance, PRBS and difference in encashment of Earned Leave to the tune of Rs.13,035/-, Rs.17,450/- and Rs.7,325/- are still due and payable to the petitioner and the same would be disbursed within a period of six(6) weeks since.

6. Thus, from the above, it is evident that though the petitioner was retired from service as early as on 31.03.2020 amounts that are payable to the petitioner by the respondents 1 and 2 are not paid within a reasonable time. Therefore the respondents are liable to pay the said amount together with 6% interest from the date on which the said due amount till the amount due is finally paid to the petitioner.
