Order

This writ petition has been filed seeking a mandamus to direct the respondent to correct the father’s name in the birth certificate of the petitioner’s minor son based on the representation sent by her dated 20.09.2026.

2. The petitioner would submit that she married one Senthil Kumar on 10.02.2006, and their marriage was dissolved by a decree of divorce dated 17.02.2018 passed by the Principal Family Court, Chennai. Subsequently, she married one Ramraj on 07.03.2021, and a male child, Minor Mithran, was born to them on 11.05.2022 at the Institute of Child Health and Hospital for Children, Egmore.

WP No. 43013 of 2026

3. The petitioner would further submit that, upon obtaining the birth certificate of her minor son from the Greater Chennai Corporation, she found that the name of her former husband had been erroneously entered in the column relating to the father's name instead of the name of the child's biological father, Ramraj. On enquiry, she was informed that the incorrect entry had been made based on the particulars contained in her Aadhaar Card, wherein her former husband's name had been mentioned as her husband. Subsequently, she corrected her Aadhaar Card by replacing her former husband's name with that of her present husband. However, the error in the birth certificate continues to remain uncorrected. Therefore, the petitioner submitted a representation dated 20.09.2026 to the respondent seeking correction of the father's name in the birth certificate, but no action has been taken so far. Hence, the present writ petition has been filed.

4. Heard the learned counsel on both sides and perused the materials available on record.

Accordingly, this writ petition is disposed of.
