ORDER

The writ petitioner claiming himself to be a registered contractor in Kanyakumari District, having participated in the tender process issued by the Kadayal Town Panchayat, has come forward with the present writ petition, challenging the tender notification on the premise that the tender inviting authority is not expected to accept tender bids which are offering less than 20% of the amount prescribed in the tender notification.

2. The learned counsel for the petitioner refers to G.O.Ms.No.555, dated 17.11.1999 in this regard and would submit that he had already

WP(MD) No. 30200 of 2026 given a representation, dated 08.10.2026 and he may be permitted to restrict his relief to seeking the said representation being disposed of.

3. Per contra, the learned Special Government Pleader appearing for the respondents 1 to 5 would submit that the said Government order referred by the learned counsel for the petitioner is not applicable to the tenders invited by the Municipal Administration and Water Supplies Department or the Panchayat Raj Department and therefore, the reference made by the learned counsel for the petitioner may not be appropriate. However, in his fairness, he would submit that the Government has now introduced a Standard Operating Procedure by way of guideline vide proceedings, dated 16.10.2026 and he had also given a copy of the said proceeding to the learned counsel for the petitioner.

4. He would submit that the petitioner may be given liberty to submit a fresh representation in the light of the Standard Operating Procedure guideline mentioned supra and if such representation is made, the same will be considered and appropriate order will be passed within a period of six weeks from the date of receipt of a copy of this order.

5. Considering the rival submissions on either side, it is evident that the petitioner is a participant in the tender notification and was not

WP(MD) No. 30200 of 2026 successful. His grievance is that if the tender inventing authority is accepting tender bids less than 20% of the offered amount, the quality may be seriously impaired. However, having participated in the tender bid and having lost in the competitive process, the petitioner cannot make any grievance or complaint against his non selection. However, in light of the fair submission made by the learned Special Government pleader, liberty is given to the petitioner to submit a fresh representation in the light of the Standard Operating Procedure, dated 16.10.2026 within a period of two (2) weeks from the date of uploading of this order copy. If any such representation is made, the same shall be considered and appropriate order shall be passed by 3rd respondent within a period of six

(6) weeks thereafter on its own merits and in accordance with Law.

6. With the above observations, this writ petition stands disposed of. No costs. Consequently, connected Miscellaneous Petitions are closed. 26-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No gbg
