COMMON ORDER

(Order of the Court was made by Sunder Mohan J.) The writ petitions have been filed by the suspended Directors of the principal borrower and the guarantor company challenging the order dated 28.09.2026 passed by the National Company Law Tribunal Division Bench II appointing an Insolvency Resolution Professional.

2. Mr.Satish Parasaran, learned Senior counsel for the petitioners would submit that the petitioners had filed these writ petitions because the appeal remedy had been rendered illusive; that though the impugned order was passed on 29.08.2026, the order was uploaded only on 05.10.2026 and the Appellate Tribunal is not functioning from 12.10.2026 and is reopening only on 26.10.2026 and hence the petitioners could not seek any interim order from the Appellate Tribunal. He therefore prayed for the order to be kept in abeyance for a short time to enable the petitioners to pursue their application for interim order before the National Company Law Appellate Tribunal. Learned Senior counsel also pointed out to the public announcement dated 08.10.2026 made by the Insolvency Resolution Professional calling for the claims from the creditors of the borrower company in question, and that if the Committee of Creditors is appointed, the petitioners would be put to irreparable loss and hardship.

3. This Court is not inclined to interfere with the impugned order as the petitioners have an alternate remedy. However, since the petitioners could not seek interim order before the Appellate Tribunal for the reasons, stated by the learned Senior Counsel, we are inclined to direct the third respondent to maintain status quo as on date till 02.11.2026, to enable the petitioners to pray for appropriate relief before the Appellate Tribunal.

4. With the above observations, the writ petitions are disposed of. No costs. Consequently, connected miscellaneous petitions are closed. (S.M.,J.) (G.K.M.,J.) 23-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No SR/MMI To
