ORDER

Heard Mr. L.S.M.Hasan Fizal, representing Mr.P.Kumaravel learned counsel for the petitioner and Mr.Hari Radhakrishnan, learned counsel for respondents 1 and 2.

2. In the light of the relief sought in the writ petition, notice to the third respondent is dispensed with.

3. The petitioner is undergoing her studies at the third respondent institution. On account of the fact that she secured 39.5% in Anatomy theory paper, her results were not declared. Therefore, she was not able to proceed to the second year. Hence, she filed W.P.No.46615 of 2025. The same came to be allowed on 09.12.2025. The petitioner started attending the second year MBBS course. Thereafter, the grievance of the petitioner is that though she has the requisite attendance, she has not been permitted to take the second year examination. This is on account of the fact that the university has preferred an appeal against the order in W.P.No.46615 of 2025 vide W.A.No.1615 of 2026.

4. It is the submission of Mr.Hari Radhakrishnan, learned counsel appearing for respondents 1 and 2, that though notice has been issued in the appeal, the order passed by the learned Single Judge has not been kept in abeyance.

5. When a positive direction has been given by this Court and the order has not been kept in abeyance, the respondents 1 and 2 are duty bound to obey the same. Since the petitioner is otherwise eligible, the respondents point out the pendency of the appeal as a ground not to open the portal and receive her examination fee cannot be treated as valid. Hence, this Writ Petition is ordered in the following terms:

(1) Respondents 1 and 2 shall permit the petitioner to enter her details in the examination portal.

(2) The petitioner shall pay the requisite fee to take up the examination.

(3) In the event that W.A.No.1615 of 2026 is allowed, the fact that the petitioner took the second year examination would not enure in her favour. 23-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No rpl/Aj To
