IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA Cr. MMO No. 672 of 2025 Reserved on: 7.10.2026 Date of Decision: 16.10.2026 Yogeshwar Singh & ors. ...Petitioners Versus State of H.P. & ors. ...Respondents
Coram
Hon’ble Mr Justice Rakesh Kainthla, Judge. Whether approved for reporting? No. For the petitioners : Mr
Amrinder
Singh
Rana, Advocate. For Respondents No.1 and 2/State : Mr Ajit Sharma, Deputy Advocate General. Rakesh Kainthla, Judge The petitioner has filed the present petition under Section 482 of the Code of Criminal Procedure, 1973 (Cr.P.C.) for quashing of F.I.R. No. 352 of 2023, dated 27.12.2023, registered at Police Station Nalagarh, District Solan, H.P., for the commission of offences punishable under Section 3(1)(s) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 (SC/ST Act) and Section 506 read with Section 34 of the Indian
Penal Code, 1860 (IPC), based on a compromise entered into between the parties.
2. It has been asserted that the dispute between the parties has been amicably sorted out with the intervention of respectable persons of the society. The informant does not want to proceed further with the matter after the compromise. No fruitful purpose would be served by continuing with the prosecution. Hence, it was prayed that the present petition be allowed and the F.I.R. and consequential proceedings arising out of it be quashed based on the compromise between the parties.
3. The statement of the informant/victim, Jaswinder Kaur, was recorded on 24.8.2026, in which she stated that she had entered into a compromise with the petitioner and had no objection to the quashing of the F.I.R. based on the compromise between the parties.
4. The offence punishable under Section 506 of the IPC is compoundable under Section 320 of the Cr.P.C. Section 320(3) of the CrPC provides that when an offence is compoundable under this section, the abetment of such offence, or an attempt to commit such offence (when such attempt is itself an offence), or where the accused is liable under Section 34 or 149 of the Indian Penal Code, the offence may be compounded in like manner. Hence, the offence punishable under Section 506 read with Section 34 of the IPC can be compounded.
5. This Court has already quashed the F.I.R. registered for the commission of offences punishable under Section 3 of the SC & ST Act in Rasik Sharma Vs. State of H.P. 2024 STPL 8598 HP, Krishan Lal and others Vs. State of HP and others, 2022 STPL 10793 HP, Satish Kumar and Others Vs. State of HP and others, 2022 STPL 10703 HP, Vinod Kumar & Ors. Vs. State of HP and others, 2017 STPL 10679 HP, and Lalit Singh and others Vs. State of HP and others, Cr. MMO No. 326 of 2016-Decided on 17.04.2017 based on compromise. These judgments are binding on this Court.
6. Therefore, in view of these precedents, the present petition is allowed and F.I.R. No. 352 of 2023, dated 27.12.2023, registered at Police Station Nalagarh, District Solan, H.P., for the commission of offences punishable under Section 3(1)(s) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 (SC/ST Act) and Section 506 read with
Section 34 of the Indian Penal Code, 1860 (IPC) and consequential proceedings arising out of the said F.I.R. are quashed.
7. Petition stands disposed of in the above terms, so also pending miscellaneous applications, if any.
8. Parties are permitted to produce a copy of this judgment, downloaded from the webpage of the High Court of Himachal Pradesh, before the authorities concerned, and the said authorities shall not insist on the production of a certified copy, but if required, may verify passing of the order from the Website of the High Court.
