ORDER

This civil revision petition has been filed under Article 227 of the Constitution of India against the order dated 24.11.2025 made in I.A.No.4 of 2025 in HMOP.No.3840 of 2019 on the file of the IV Additional Family Court,

Chennai, wherein based on the application filed by the 1st respondent under Sections 24 and 25 of Hindu Marriage Act, 1955, the Court below fixed monthly maintenance of Rs.50,000/- payable to the 2nd respondent/child pending disposal of the OP.

2. Heard learned counsel for the petitioner and learned counsel for the respondents and carefully perused the materials available on record. This Court also went through the impugned order.

3. The 1st respondent filed OP.No.5203 of 2019 seeking for the relief of restitution of conjugal rights. The petitioner has filed OP.No.3840 of 2019 seeking for the relief of dissolution of marriage. Pending these petitions, the 1st respondent filed application for interim maintenance.

4. The Court below, on considering the rival claims and the financial capacity of both the petitioner as well as the 1st respondent, came to the conclusion that the petitioner must pay interim monthly maintenance of Rs.50,000/- to the 2nd respondent/child, pending disposal of the OP.

5. Aggrieved by the said order, the present civil revision petition has been filed before this Court.

6. When the civil revision petition was entertained, this Court passed an interim order directing the petitioner to pay arrears of maintenance at the rate of 50% and also continue to pay the monthly maintenance at the rate of 50% out of the interim maintenance fixed by the Court below. It is brought to the notice of this Court that the maintenance amount has been paid as directed by this Court.

7. On carefully going through the order passed by the Court below, it is seen that the petitioner is working in United States of America and the 1st respondent is also employed and she is also sufficiently earning to take care of herself. Hence, the Court below fixed monthly maintenance payable only to the 2nd respondent/child.

8. Considering the salary that is earned by the petitioner in Unites States in US dollars, the Court below has only fixed a sum of Rs.50,000/- per month(500 dollars) as interim maintenance for the child. By no stretch, the order passed by the Court below suffers from any perversity or the maintenance amount fixed by the Court below can be termed as excessive. Hence, this Court is not inclined to interfere with the order passed by the Court below.

9. In view of the above, the order passed by the Court below is sustained and there shall be a direction to the petitioner to deposit the balance arrears of maintenance amount upto October, 2026 payable to the 2nd respondent/child

N.ANAND VENKATESH J. mp within a period of four (4) weeks from the date of receipt of a copy of this order. The petitioner will continue to pay the maintenance for the 2nd respondent/child at the rate of Rs.50,000/- till the disposal of the OP.

10. Considering the fact that the petition is pending from the year 2019, there shall be a direction to the IV Additional Family Court, Chennai, to dispose of O.P.Nos.3840 of 2019 and 5203 of 2019 within a period of three (3) months from the date of receipt of a copy of this order. In the result, this Civil Revision Petition is disposed of in the above terms. No costs. Connected miscellaneous petition is closed. 16-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No mp To The IV Additional Family Court, Chennai.
