ORDER

This civil revision petition has been filed under Article 227 of the Constitution of India against the order dated 15.04.2024 passed in I.A.No.1 of 2023 in H.M.O.P.No.61 of 2021 on the file of Principal Sub Court, Virudhachalam, wherein the application filed by the petitioner seeking for DNA

profiling of the petitioner, respondent and the child born to the respondent, came to be dismissed by the Court below.

2. Heard learned counsel for the petitioner and learned counsel for the respondent and carefully perused the material available on record. This Court also went through the impugned order.

3. The respondent has filed HMOP.No. 61 of 2021 seeking for the relief of restitution of conjugal rights. The petitioner, who is the husband filed a counter claim and sought for dissolution of marriage on the ground of cruelty, desertion and adultery.

4. According to the petitioner, the respondent had deserted the petitioner during March, 2017 and thereafter, during November, 2018, the respondent delivered a child and according to the petitioner, there was absolutely no contact whatsoever between the petitioner and the respondent from March, 2017. Therefore, the petitioner wanted DNA profiling to be done for the petitioner, respondent and the child. The said application was dismissed by the Court below.

5. When the matter was taken up for hearing today, the learned counsel for the respondent submitted that the respondent is willing for the DNA

profiling.

6. In the light of the above submission, without going into the merits of the case, the Court below shall proceed further with the process of DNA profiling. This civil revision petition is disposed of in the above terms. No costs. Connected miscellaneous petition is closed. 16-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No mp To The Principal Sub Court, Virudhachalam.
