ORDER

This Civil Revision Petition has been filed under Article 227 of the Constitution of India, challenging the docket order passed by the Court below dated 05.10.2026, refusing to entertain the commercial suit filed by the petitioner/plaintiff.

2. Heard the learned counsel for the petitioner and carefully perused the materials available on record and this Court also carefully went through the order passed by the Court below.

3. The petitioner/plaintiff has filed the suit seeking for the relief of permanent injunction restraining the defendant from in any manner interfering with the peaceful possession and enjoyment of the suit property and for a declaration that the plaintiff is entitled to renewal of the lease of the suit property pursuant to the registered Lease Deed dated 11.12.2020 and for a declaration that the notice dated 16.09.2026, terminating the Lease Deed, is invalid and inoperative.

4. The Court below passed a docket order dated 05.10.2026 and refused to entertain the suit mainly on two grounds, viz., (a) the plaintiff has valued the

relief at Rs.7,000/-, whereas the Commerical Court cannot entertain a suit below the specified value of Rs.3,00,000/- and b) a notice 16.09.2026 has been issued, terminating the lease agreement and aggrieved by the same, the plaintiff has approached the Court. However, there is no urgent or imminent interim relief is apparent from the pleadings in the plaint, and therefore, the plaintiff must comply with Section 12A of the Commercial Courts Act.

5. Insofar as the first ground raised against the petitioner is concerned, the learned counsel for the petitioner submitted that the necessary pleadings regarding valuation have been made in the plaint and that the suit has been valued at more than Rs.3,00,000/-. However, by mistake, the total valuation has been shown as Rs.7,000/- in paragraph 73 of the plaint. The learned counsel submitted that the necessary correction will be made and the plaint would be re- presented.

6. Insofar as the second ground raised against the petitioner/plaintiff is concerned, a careful reading of the plaint, more particularly, Paragraph 68 of the plaint shows that there is an urgency in moving the suit, since the enjoyment of the property is being disrupted by the respondent/landlord and therefore, the plaintiff has also filed an application under Section 12A of the Commercial Courts Act. Therefore, the finding of the Court below that there are no

pleadings regarding urgent and imminent interim relief in the plaint cannot be sustained.

7. In view of the above, the petitioner/plaintiff is directed to carry out the necessary corrections in the plaint and it shall be re-presented along with the affidavit filed in support of the application under Section 12A of the Commercial Courts Act and the other interlocutory application seeking for interim injunction and the same shall be entertained by the Court below and the Court below shall proceed further in accordance with law.

8. In the result, this Civil Revision Petition stands disposed of in the above terms. No Costs. Consequently, the connected miscellaneous petition is closed. 16-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No SSR
