ORDER

This Writ Petition has been filed to direct the respondents to consider the petitioner’s representation dated 02.12.2025 and consequently conduct a proper survey and technical inspection and consider the feasibility of taking the surplus-water channel from Paradesipatti Lake through the northern side/edge

of the petitioner’s patta lands comprised in Survey Nos.259/2, 259/3, 267/2, 267/1A2 and 267/1A1, instead of forming the channel through the middle of the said lands, after affording the petitioner an opportunity of hearing.

2. The grievance of the petitioner is that he is the absolute owner and in possession and enjoyment of the lands comprised in Survey Nos.267/1A1, measuring 1.10.93 hectares, and 267/1A2, measuring 0.02.43 hectares, situated at Padanavadi Village, Tirupattur Taluk, Tirupattur District, having purchased the same under a registered Sale Deed dated 04.02.2004, bearing Document No.437/2004, and Patta No.9777 stands in his name. His wife, Tmt.Vidhya, is also the owner of the adjacent lands comprised in Survey Nos.259/2, 259/3 and 267/2, covered under a registered Settlement Deed dated 10.05.2024, bearing Document No.3341/2024, in respect of which Patta No.10030 stands in her name. The grievance of the petitioner is that the respondents are taking steps to form a surplus-water channel from Paradesipatti Lake towards the eastern side to connect with the existing channel leading from Kandhili towards Kakangarai, and the proposed alignment is stated to pass through the middle of the petitioner's and his wife's patta lands, thereby dividing the agricultural lands and adversely affecting their cultivation, access and peaceful enjoyment. The petitioner has no objection to the lawful discharge of surplus water or to the public purpose involved, but requests the respondents to consider the feasibility of forming the channel along the northern side of the lands, so as to minimise

the prejudice caused to their properties. In this regard, the petitioner submitted a representation dated 02.12.2025, requesting consideration of an alternative alignment. Since the said representation was not considered, the petitioner caused a legal notice dated 16.03.2026 to be issued to the respondents, requesting them not to proceed with the proposed alignment without considering his representation and alternative proposal. Since no action has been taken by the respondents, the petitioner has filed the present Writ Petition.

3. The learned Special Government Pleader appearing for the 2nd respondent would submit that if a specific time frame is fixed by this Court, the 2nd respondent will consider the petitioner’s representation and pass appropriate orders on its own merits in accordance with law.

4. Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for the 2nd respondent.

5. This Court considering the limited scope of the prayer sought by the petitioner and without going into the merits of the case, directs the 2nd respondent to consider the petitioner's representation dated 02.12.2025 on its own merits and pass appropriate orders in accordance with law, after conducting a proper enquiry and providing an opportunity of personal hearing to the petitioner, as well as to any other interested parties or rival claimants, within a

period of eight weeks from the date of receipt of a copy of this order.

6. It is made clear that this Court has not expressed any opinion on the rights of the parties or any other aspects of the case.

7. Accordingly, this writ petition is disposed of. No costs. 16.10.2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No vv2 To
