Order

This petition has been filed seeking a direction to the first respondent to dispose of the enquiry contemplated in proceedings namely Na.Ka. No 1053 / 2025 / Aa1 dated 10.03.2025 issued by the second respondent to the first respondent, pursuant to the petitioner representation dated 25.01.2025 made to the first respondent.

2. The petitioner inherited the subject property from his grandfather, who had purchased the same in the year 1944. However, without any trace of title, the third respondent was issued a patta for the subject property, and consequently, the petitioner made a representation dated 25.01.2025 to the first respondent. Since no action was taken by the respondents, the petitioner has approached this Court by filing this writ petition.

3. The learned Special Government Pleader appearing for the respondents one and two submitted that if a specific time frame is fixed by this Court, the first respondent will conclude the enquiry and pass appropriate orders on its own merits and in accordance with law.

4. Heard both sides and perused the materials available on record.

WP No. 41761 of 2026

5. Since no order prejudicial to the interest of the third respondent is being passed in this writ petition, notice to the third respondent is dispensed with and this Writ Petition is taken up for final disposal at the admission stage itself.

6. Since the core issue involved in this writ petition is the time bound completion of the enquiry, this Court directs the first respondent to conclude the enquiry initiated vide proceedings dated 10.03.2025 and pass orders on the same within a period of sixteen weeks from the date of receipt of a copy of this order, on its own merits and in accordance with law, after providing an opportunity of hearing to all the parties concerned.

7. It is made clear that this Court has not expressed any opinion on the merits of the claim made by the petitioner. If there is any dispute relating to the title or inter-se civil rights over the property, the parties are at liberty to approach the competent Civil Court for appropriate relief. With the above directions, this writ petition is disposed of. No costs. K.SURENDER J. 16-10-2026 Index: Yes/No VCA
