PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents 1 to 4 herein to consider the petitioner’s representation dated 17.04.2026 and the reminder dated 14.07.2026 by way of completely survey measure and identify all illegal encroachments made by the Respondents 5 to 9 in Survey Nos.220/49 and 478/6 situated at Manalmettupatti Village (hamlet of Chokkalingapuram Village) Melur Taluk, Madurai District and subsequently remove all such encroachments

structures, fences and gardens to clear the pathway leading to the petitioner’s property in Survey No.220/45, within a time frame to be fixed by this Court.

ORDER
(Order of the Court was made by G.R.Swaminathan J.) Heard the learned counsel appearing for the writ petitioner and the learned Special Government Pleader appearing for the official respondents. Issuance of notice to the private respondents is dispensed with.
2. The petitioner alleges that there are encroachments in the petition-mentioned survey numbers. She wants the same to be removed.
3. When the matter was taken up for hearing, the learned Special Government Pleader, on instructions, submitted that Survey No.220/49 has been classified as “Theru” and Survey No.478/6 has been classified as “Pathai”.

4. We direct the third respondent to conduct survey. If the third respondent is satisfied that there are encroachments, the same shall be removed by adhering to due process of law. The entire exercise shall be completed within a period of four months from the date of receipt of a copy of this order.
