ORDER
The petitioner relies on proceedings dated 28.11.2013, recognising his father, Periyan, as a hereditary trustee and a subsequent order dated 01.07.2021, recognising the petitioner as a temporary poojari. Alleging that he is being prevented from performing poojas at Arulmigu Parayan Karuppusamy Thirukovil, Sukkampatti, the present Writ Petition has been filed.
2. Mr. R.Parthiban, learned Special Government Pleader, accepts notice for the first respondent. Mr.P.Athimoola Pandian, learned counsel, accepts notice for the second respondent. Mr.S.Sonaimuthu, learned counsel, accepts notice for the third respondent.
3. Learned counsel for the third respondent submits that this Writ Petition is liable to be dismissed in view of the judgment of the Hon’ble Division Bench of this Court in W.A. (MD) No.573 of 2021 dated
WP(MD) No. 29945 of 2026 18.02.2025.
4. Learned counsel for the second respondent submits that one Ganesan has been appointed as a temporary poojari under proceedings dated 13.03.2026 and that such proceedings are subject to the outcome of the proceedings pending before the Joint Commissioner. He also submits that the order dated 01.07.2021 only appointed the petitioner as a temporary poojari and that the said order cannot be relied upon after the lapse of five years.
5. Under Section 54 of the TNHR&CE Act, 1959, the next in line is entitled to succeed as a hereditary trustee. A decision in this regard is required to be taken after considering the claims made by the members of the family. It appears that a petition has been filed by the third respondent herein before the Joint Commissioner and said petition is pending consideration.
6. Considering the above submissions, this Writ Petition is disposed of by directing the first respondent to consider and dispose of the petition filed by the third respondent within six (6) months from the
WP(MD) No. 29945 of 2026 date of receipt of a copy of this order. Until such time, the temporary poojari appointed under the order dated 13.03.2026 shall function as the poojari. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed. 16-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No apd To
