ORDER
Apprehending that the third and fourth respondents will put up construction on the petitioner's patta lands in Survey Nos.145/2 and 127/5 at K.Edaiyavalasai Village, the petitioner has approached this Court.
2. Accepting notice for the respondents, Mr. P.Pethu Rajesh, learned Additional Government Pleader and Mr.S.Sivasubramani, learned Government Advocate, submit that no construction would be put up in the two survey numbers over which the petitioner asserts rights. They submit that the owner of Survey No.127/4 intends to gift the said land to the fourth respondent Panchayat. Any work relating to the channel running through Survey No.127/4 would be undertaken after the gift is made.

3. Recording the above submissions that no construction work would be carried out on the lands over which the petitioner asserts rights, this Writ Petition is disposed of. In case any survey is necessary for the purposes of demarcating the boundaries, the petitioner and other affected parties shall be put on notice, and said survey shall be carried out in accordance with the Tamil Nadu Survey and Boundaries Act, 1923.
