ORDER

The Writ Petition has been filed in the nature of a Writ of Mandamus directing the respondents to consider and dispose of the petitioner’s application seeking cancellation of the settlement deed, dated 24.07.2026 bearing Document No.3086 of 2026 in favour of the 6th respondent and consequently restrain further alienation or creation of third-party rights in respect of the subject property.

2. Heard Mr.K.Rajendran, learned Counsel for the petitioner and Mr.M.Dinesh Hari Sudarsan, learned Additional Government Pleader, who accepts notice on behalf of the respondents 1 and 2. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage.

3. The petitioner had approached the officials respondent with a representation, dated 06.08.2026 seeking to cancel a settlement deed, which had been registration as Document No.3086 of 2026, dated 24.07.2026. In that regard, it had been repeatedly held by this Court that the registering authority do not have a jurisdiction to cancel a document which had already been registered. It is only appropriate for the aggrieved party to approach the civil Court challenging the said document. Hence, the registering authority, who do not have a jurisdiction to cancel a registered document, need not be compelled by this Court in a Writ of Mandamus to consider the representation made in that regard.

4. In result, the Writ Petition stands dismissed with liberty to the parties to approach the competent civil Court. There shall be no order as to costs. 16-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No cmr To
