ORDER

The petitioner School is a Government Aided School governed by the provisions of the Tamil Nadu Recognised Private Schools (Regulation) Act and the Rules. There are 293 students studying in the petitioner School (172 students in Standards I to V and 121 students in Standards VI to VIII). As per the staff fixation order, out of eight Secondary Grade Teachers for Standards I to V, six teachers are within the sanctioned strength and two teachers, namely, S. Deivanbu and S. Balumahendran, have been declared as surplus Teachers. However, the fact remains that out of six teachers working within the sanctioned strength, one Teacher, namely, Tmt.T.Jayaveni is on medical leave from 22.07.2026 onwards for taking cancer treatment and she is due to retire from service at the end of the Academic Year, ie. on 31.05.2027. Another Teacher, by name, Smt.S.Padmavathi, has submitted a representation seeking Voluntary Retirement from Service, in the month

WP(MD) No. 30081 of 2026 of August 2026 and she is likely to retire from service under VRS upon expiry of the statutory period of three months. In such circumstances, the students will be made to suffer for want of teachers, if the two teachers are declared surplus and deputed to other schools. Therefore, the petitioner school submitted a representation to the 2nd and 3rd respondents on 19.09.2026, requesting not to depute the two Secondary Grade Teachers from the petitioner School. However, the 3rd respondent issued an order dated 06.10.2026, deploying the Teachers declared surplus to Panchayat Union Primary Schools. Therefore, the petitioner School has filed this writ petition seeking a Writ of Mandamus to the respondents to revoke the deputation order and permit the said Teachers to continue in the Petitioner School, by considering its representation dated 19.09.2026.

2. Though this Court is not inclined to entertain the relief sought for by the petitioner School, seeking interference on the order of deployment, considering the submission of the petitioner School that a Teacher is likely to retire from service under VRS on the expiry of statutory period of three months and another Teacher, who is on medical leave for taking cancer treatment, is due to retire from service at the end of the Academic Year, ie. on 31.05.2027, resulting in two vacancies in the petitioner School in the month of November 2026, this writ petition is

WP(MD) No. 30081 of 2026 disposed of with a direction that the Teachers, who have been deployed from the petitioner School, shall be considered for accommodation in the petitioner School as and when vacancies arose therein. No costs. Consequently, connected miscellaneous petition is closed. 16-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No ogy To
