PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned election notification dated 04.09.2026 issued by the 3rd respondent in connection with the election of the India Evangelical Lutheran Church (IELC), Nagercoil Synod, Kanyakumari District and quash the same as illegal, arbitrary and contrary to Section 17(ii) of the Bye-laws of the India Evangelical Lutheran Church based on Petitioners representation dated 16.09.2026 and consequently direct the 1st respondent to constitute the Election Commission strictly in accordance with the said Bye-laws, finalise and publish a valid electoral roll, afford all eligible members a fair opportunity to participate in the election and submit their nominations and conduct the election afresh in accordance with the applicable rules and procedures of the Bye-laws of the India Evangelical Lutheran Church.

ORDER
This writ petition is filed by an alleged voter of a private society seeking to challenge the election for the said private society, which is scheduled to be held on 18th October 2026.
2. To a pointed question from the Bench, as to how this writ petition challenging the election notification issued to a private society registered under the Central Act 21 of 1860 and presently governed by the provisions of the Tamil Nadu Societies Registration Act, 27 of 1975 is maintainable, the only answer given by the learned counsel for the petitioner is that he is alleging serious irregularities in the management of the affairs of the society.
3. The above is not sufficient to maintain this writ petition. Any dispute concerning the internal administrative affairs of a private society is not amenable to writ jurisdiction. It is a settled legal position that an election notification issued with regard to a private registered society is not amenable to writ jurisdiction. __________
