Coram
Hon’ble Mr. Justice Sandeep Sharma, Judge. Whether approved for reporting?
For the Petitioner: Mr. Om Parkash Goel, Advocate.
For the Respondent: Mr. Amrit, Advocate vice Mr. Mohit Thakur, Advocate. ___________________________________________________________________________
Sandeep Sharma, J. (Oral)
Learned counsel representing the respondent-Corporation fairly states that all due and admissible amounts, save and except arrears on account of revised pay scale, stand released/paid to the petitioner.
2. Learned counsel representing the petitioner, while fairly admitting factum with regard to petitioner’s having received arrears on account of leave encashment and DCRG, states that arrears of revised pay are not being released for wholly unjustified reasons for last so many years, as a result thereof, petitioner is on the verge of starvation. 3. Learned counsel representing the respondent, though attempted to state that arrears of revision shall be paid after disposal of review filed in Tulsi Ram's case, but he was unable to dispute that no stay has been granted in Tulsi Ram's judgment. If it is so, there is no occasion, if any, for the respondent Corporation to withhold the arrears on account of revision of pay scale.
4. Consequently, in view of the above, present petition is disposed of with the direction to the respondent Corporation to release the arrears on account of revised pay scale within a period of four months, failing which petitioner would be at liberty to get the present petition revived so that appropriate action in accordance with law is taken towards implementation of the order/judgment.
