IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA
CWP No.2466 of 2026
Date of Decision: 13.10.2026 _____________________________________________________________________ Jasbir Singh ……...Petitioner Versus State of Himachal Pradesh and Ors. …....Respondents
Coram
Hon’ble Mr. Justice Sandeep Sharma, Judge. Whether approved for reporting?
For the Petitioner: Mr. Subhash Sharma, Senior Advocate with Mr. Prantap Sharma, Advocate.

Sandeep Sharma, J. (Oral)
Precisely, the grouse of the petitioner as has been highlighted in the petition and further canvassed by Mr. Subhash Sharma, learned Senior counsel representing the petitioner is that despite repeated requests made to the competent authority i.e. Settlement Officer, Shimla, prayer for demarcation is not being accepted, as a result thereof, petitioner is finding it difficult to protect his property, which is being encroached by the adjoining landowners.
2. Pursuant to notices issued in the instant proceedings, respondents have filed reply, wherein it is stated that on account of High Court of H.P. ::: Downloaded on - 28/10/2026 17:18:04 :::CIS
2 overlapping of musabis of two villages, demarcation cannot be done on spot.
3. Aforesaid reason assigned for not conducting demarcation is not only untenable, but cannot be expected from the revenue agency, which is otherwise under obligation to resolve boundary disputes, if any, between two landowners. Prayer for demarcation made by the petitioner or any other similarly situate person cannot be delayed or refused on the ground that musabis of two villages are overlapping, rather, in that regard, corrective steps are required to be taken by the competent authority.
4. Be that as it may, this Court, having taken note of innocuous prayer made by the petitioner, without going into the merits of the case, deems it fit to dispose of the same with a direction to Settlement Officer, Shimla, to ensure that demarcation as is prayed through applications, (Annexure P-1 & Annexure P-8), is considered and decided expeditiously, preferably within a period of two months. Needless to say, while doing the needful in terms of instant order, notices shall be issued to the petitioner as well as other stakeholders.
5. List for compliance on 28.12.2026.
