IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA CWP No. 15668 of 2026

Date of Decision: 13.10.2026 ______________________________________________________________ Dr.YSPUHF

……...Petitioner

Versus Preet Pal

…....Respondent

Coram

Hon’ble Mr. Justice Sandeep Sharma, Judge. Whether approved for reporting?

For the Petitioners: Mr. Ramesh Chand Sharma, Advocate.

For the respondents: Nemo.

Sandeep Sharma, J. (Oral)

Petitioner herein is aggrieved of order dated 11.08.2025 passed by the learned Senior Civil Judge, Solan, District Solan, Himachal Pradesh, in Execution Petition No. 36/10 of 2022, whereby a direction came to be issued to the petitioner/judgment-debtor to comply with award dated 31.07.2019 within a period of 60 days, failing which petitioner would be liable to pay 25% of the back wages from the date of termination till his re-engagement.

2. Though an attempt came to be made by learned counsel for the petitioner to set up a case that since respondent had never worked during the period from 1997 till 2014, there was no occasion for the executing court to pass the order in the instant proceedings, but once it is not in dispute that award dated 31.07.2019 passed by the learned Labour Court, which came to be executed by the learned Senior Civil Judge, Solan, District Solan, vide impugned order, has already attained finality in CWP No. 2345 of 2019, no illegality can be said to have been committed by the executing court while passing impugned order. 3. Consequently, in view of the above, this Court finds no illegality or infirmity in the impugned order and as such, present petition fails and is dismissed accordingly. Pending application(s), if any, stand disposed of.
