CRP No. 2515 of 2025
2023 in HMOP.No. 07 of 2017 by the learned Subordinate Court, Dharmapuri, wherein the application filed by the respondent to condone the delay of 1960 days in setting aside the exparte decree dated 30.06.2017, came to be allowed by the Court below.
2. Heard both sides and carefully perused the materials available on record as well as the order passed by the Court below.
3. The Court below allowed the application mainly on the ground that the summon had not been properly served on the respondent. This is a sufficient ground for the Court to condone the delay in filing the application to set-aside the exparte decree and it does not require the interference of this Court.
4. It is brought to the notice of this Court that after the exparte decree was passed, the petitioner married another women. It is further submitted that the respondent filed maintenance case and it was ordered and maintenance amount was also fixed. These issues will have to be agitated before the Court below and it is not necessary for this Court to go into these issues in the present Civil Revision Petition.
