Order

This Civil Revision Petition has been filed challenging the docket order passed in OS No.393 of 2024 dated 12.06.2025 by the Principal District Munsif Court, Poonamalle.

2. Heard both sides and carefully perused the materials available on record as well as the order passed by the Court below.

3. The respondent /plaintiff filed a summary suit against the defendant association. Mr.Praveen Balasubramaniam filed a memo through his counsel stating that he is not the Secretary of the defendant association. Inspite of the same, the plaintiff continued to prosecute the suit against the association. The plaintiff also filed a memo to the effect that Mr.Praveen Balasubramaniam was the Secretary of the defendant association at the relevant point of time and had also received the notice on behalf of the association.

4. On 12.06.2025, based on the memo filed by the plaintiff, the same was recorded and the defendant’s counsel was directed to comply with the order

CRP No. 2623 of 2025

XXXVII Rule 3(3) of CPC. Aggrieved by the said docket order, the present Civil Revision Petition has been filed before this Court.

5. In the considered view of this Court, if Mr.Praveen Balasubramaniam is not the secretary of the defendant association, it is quite curious that he has been contesting the proceedings right from the year 2024 onwards. Mr.Praveen Balasubramaniam could have completely disregarded the present proceedings and gone on his way since the suit has not been filed against him in his individual capacity. It is for the defendant association to prosecute the suit. Therefore, the attitude of Mr.Praveen Balasubramaniam in continuing to prosecute the case till date, shows that there is something more than what meets the eye.

6. In the light of the above discussion, the order passed by the Court below does not suffer from any perversity warranting the interference of this Court and if the defendant association is going to be represented by another secretary, it is for the defendant association to take a decision in that regard.

7. In the result, this civil Revision petition stands dismissed. No costs. Consequently, the connected miscellaneous petition stands closed. 15-10-2026 Index: Yes/No Speaking/Non-speaking order RKA
