ORDER

The plaintiff in O.S. No. 5796 of 2024 on the file of VII Assistant City Civil Court, Chennai, is the revision petitioner herein. Aggrieved by the return of the application in I.A. SR. No. 47588 of 2026, in and by which the petitioner had sought for correction of his name as V. Sekaran instead of V. Sekar, the present civil revision petition has been filed.

2. The suit in O.S. No. 5796 of 2024 was decreed on 11.06.2026 after an elaborate trial. During the course of trial proceedings, by inadvertence, the plaintiff/revision petitioner did not notice the fact that he has been described as ‘V. Sekar’ and not as ‘V. Sekaran’. The Trial Court, on the ground that the suit has already been decreed, returned I.A.SR. No. 47588 of 2026 filed by the plaintiff seeking correction of his name and consequently, the judgment and decree dated 11.06.2026 had the incorrect name of the plaintiff as ‘V.Sekar’ instead of ‘V. Sekaran’.

3. Today, Mr.T.R. Udayakumar, learned counsel, who entered appearance by filing vakalath on behalf of the respondent/defendant in the suit expressed ‘No Objection’ for the amendment of the plaintiff’s name.

4. In support of the claim of the plaintiff that his actual name is ‘V.

3\8 Sekaran’, acceptable documentary evidence, namely, Pan Card, Aadhaar Card and Voter ID card have been filed.

5. In the light of the above, I do not intend to have the fruits of the decree denied to the plaintiff/revision petitioner on the ground of misdescription of his name. In fact, the learned counsel for the respondent, in all fairness, stated that the plaintiff’s name is only ‘V. Sekaran’ and there is no objection on the part of the respondent/defendant to carry out the necessary corrections as prayed for.

6. Hence, the return dated 02.07.2026 made in I.A.SR. No. 47588 of 2026 is set aside and the application in I.A.SR. No. 47588 of 2026 is allowed in view of ‘No Objection’ expressed by the learned counsel for the respondent/defendant. The Trial Court shall number I.A.SR. No. 47588 of 2026 and in view of the order passed in this civil revision petition, shall permit the plaintiff to carry out necessary corrections in the plaint; file an amended copy of the plaint; thereafter, carry out corresponding corrections in the judgment and decree and issue fresh copy of judgment and decree in O.S. No. 5796 of 2024 to the plaintiff as well as to the defendant.

7. With the above directions, the Civil Revision Petition stands allowed. No costs.
