2. Since no adverse order is passed as against the respondents, notice to the respondents is dispensed with.

3. It is seen from the typed-set of papers that one Tamil Mani and two others filed a suit in O.S.No.239 of 1998 on the file of the Subordinate Court, Salem seeking following reliefs:-

a) appointing an administrator or panel of administrators as the Honourable Court may deem fit and proper with a direction to obtain a true and correct accounts of the assets and liabilities of Late P.S.Shanmugham, Chithra Kala and Minor Upendra Sundara Raj and that of the Defendants 1 to 4 and take possession of the properties and administer them and prepare a list of creditors and sell the properties and realise all other assets and discharge the debts due to the creditors and other liabilities according to law and handover the remaining assets to the defendants.

b) prohibiting the defendants by mean of a permanent injunction from in any manner alienation encumbering or parting with possession of the suit properties and such other items of properties in their possession and power.”

4. In the said suit, the petitioners who are arrayed as defendants 1 and 2 filed an application in I.A.No.214 of 2018 seeking to discharge the Administrators appointed by the Court to administer the estate of late P.D.Shanmugam and to direct administrators to file full and true inventory of moveable, immoveable properties, credits and debts of the estate before the Court and to direct the Administrators to deposit to the Court all the monies available in cash in hand and in bank accounts maintained by them and to direct them to surrender to the Court all the documents, title and properties and income from the estate.

5. It is seen from the petition order in I.A.No.214 of 2018 though the application was filed in the year 2018, the IA is still pending and it is also seen that both sides were heard as early as 15.02.2023. However, no final orders have been passed in the said IA.

6. Taking into consideration the IA was filed in the year 2018 and eight years have gone, from the date of filing of IA, this Court is inclined to direct the Trial Court to dispose of I.A.No.214 of 2018, as expeditiously as possible, after giving due opportunity to all the parties.
