ORDER

This Civil Revision Petition has been filed challenging the order passed by the Executing Court, dismissing the application filed by the petitioner seeking stay of further proceedings in E.P.No.776 of 2026.

2. Though the counsel for the petitioner filed vakalath, there is no representation on behalf of him. The petitioner appeared in person and made his submissions.

3. The respondents herein filed a petition in RLTOP No.652 of 2021 under the provisions of the Tamil Nadu Regulations of Rights and Responsibilities of Landlords and Tenants Act and obtained a decree for vacant possession. The appeal filed by the petitioner in R.L.T.A.No.103 of 2024, challenging the order passed by the Rent Court was also dismissed. Thereafter, it appears that as against the dismissal of the appeal, the petitioner filed a civil revision petition in CRP No.1973 of 2025 and the same is pending. However, as per the submission made in the execution petition No.776 of 2026, no stay has been granted in the CRP. Hence, the respondents filed the Execution Petition on the file of XIII Judge, Court of Small Causes, Chennai seeking execution of the decree for re-possession granted by the Rent Court in favour of them. In the said Execution Petition, the petitioner filed the instant petition in __________

( Uploaded on: 22/10/2026 12:40:07 pm )

CRP No. 6585 of 2026 E.A.No.1 of 2026 to stay further proceedings of the execution petition, till the disposal of the civil suit filed by him in C.S.No.86 of 2020. The said petition was dismissed by the Executing Court. Aggrieved by the same, the present civil revision petition has been filed.

4. According to the petitioner, he filed a civil suit against the respondents seeking recovery of money and the same is pending. Merely because the suit for recovery of money is pending against the respondents, the execution of the order passed by the Executing Court, granting re-possession in favour of the respondents, cannot be stayed. It is for the petitioner to insist the stay petition pending in the CRP, challenging the order for re-possession passed by the Rent Court, as confirmed by the Appellate Tribunal. The Executing Court has rightly dismissed the stay petition filed by the petitioner seeking stay of the execution proceedings till the disposal of the suit filed by the petitioner. I do not find any error in the impugned order passed by the Executing Court.

5. Accordingly, this Civil Revision Petition is dismissed. There shall be no order as to costs. 15-10-2026 Index: Yes/No Speaking/Non-speaking order Neutral Citation: Yes/No MST __________
